​Our Digital Content Release Agreement is a way for you to help coaches and the platform by allowing the use your lesson Content for marketing and promotional purposes.

This Digital Content Release Agreement ("Agreement") is made and entered into by and between the following parties:

• The Company: My Sport Guru, operating the online marketplace platform ("Company").

• The Coach: The coach providing a response to the associated Lesson on the Company's platform ("Coach").

• The Client: The individual who purchases coaching services from the Coach via the Company's platform ("Client").

 

GRANT OF RIGHTS

The Client grants the Company and the Coach a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, distribute, and display digital content, including but not limited to text, videos, images, and written testimonials ("Content"), submitted or created in connection with coaching services received through the Company's platform ("Lesson").

PURPOSE OF USE

The Client agrees that the Content may be used by both the Company and the Coach for marketing, promotional, and advertising purposes, including but not limited to social media, website displays, and digital advertisements.

REPRESENTATIONS AND WARRANTIES

The Client represents and warrants that:
    1. They have the full right and authority to grant this license.
    2. The Content does not infringe upon any third-party rights.
    3. The use of the Content as outlined in this Agreement does not violate any applicable laws.

NO COMPENSATION

The Client acknowledges that they will not receive any compensation, financial or otherwise, for the use of their Content.

REVOCATION OF CONSENT

The Client may request removal of the Content by providing written notice to the Company. The Company will make reasonable efforts to remove the Content from its active digital platforms; however, this does not extend to previously published or distributed materials. 

LIMITATION OF LIABILITY

The Client releases the Company and the Coach from any claims, demands, or liabilities arising from the use of the Content as permitted under this Agreement.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of New Zealand.

ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between the parties regarding the use of Content for the associated Lesson and supersedes any prior agreements or understandings specifically related to such use. This Agreement does not replace or modify the Company's Privacy Policy, Terms of Use or Social Media Release Agreement, which, if agreed to, remain in full force and effect. 

By agreeing to the Terms of Use on the Company's platform, the Client acknowledges and agrees to the terms set forth in this Agreement.
